Shots Fired: Range Tracker

These Terms of Service (“Terms”) govern your use of the Shots Fired: Range Tracker mobile application (the “App”) operated by OTC MVP LLC (“we,” “our,” or “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Use of the App

Eligibility

You must be at least 18 years of age to use this App. By using the App, you represent that you are 18 or older.

Permitted Use

The App is designed for lawful use by individuals to track their personal firearm range sessions, maintenance, and training goals. You agree to use the App only for lawful purposes and in accordance with these Terms.

Prohibited Use

You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to reverse engineer, decompile, or extract the source code of the App
  • Use the App in any manner that could damage, disable, or impair the App
  • Attempt to gain unauthorized access to any part of the App

2. Firearms Safety Disclaimer

The App is a data tracking tool only. It does not provide firearms training, safety instruction, or legal advice.

Nothing in this App constitutes firearms safety guidance. Always follow all applicable federal, state, and local laws regarding firearm ownership, storage, and use. Always practice safe firearm handling at all times.

We are not responsible for any injury, damage, or legal consequence arising from your use or misuse of any firearm. Use of the App does not substitute for proper firearms training.

3. Accuracy of Data

The App relies entirely on data you enter manually. We make no representations about the accuracy, completeness, or reliability of any data you enter or any calculations derived from that data (including round counts, maintenance intervals, or session statistics).

You are solely responsible for the accuracy of information you enter into the App.

4. Subscriptions and Purchases

Free Tier

The App offers a free tier with limited features. No payment is required to use the free tier.

Pro Subscription

The App offers an optional Pro subscription that unlocks additional features. Subscriptions are billed through the Apple App Store. By purchasing a subscription, you agree to Apple’s terms of service in addition to these Terms.

Billing

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
  • You can manage and cancel your subscription through your Apple ID account settings
  • We do not issue refunds for partial subscription periods, except as required by applicable law

Price Changes

We reserve the right to change subscription pricing at any time. Price changes will take effect at the start of your next billing cycle following notice.

5. Intellectual Property

The App, including its design, code, graphics, and content, is owned by OTC MVP LLC and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for your personal, non-commercial use.

You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at shotsfired.app/privacy.

7. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that any data you enter will be preserved or protected against loss.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OTC MVP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR PERSONAL INJURY.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless OTC MVP LLC and its members, officers, and agents from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the App, your violation of these Terms, or your violation of any applicable law.

10. Governing Law

These Terms are governed by the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Maricopa County, Arizona.

11. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the “Last Updated” date at the top of this page. Your continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
